Please read the following information, terms and conditions regarding your travel arrangements.

Passport and Visa Information

Please check all names provided for travel match exactly the name and spelling as per your passport identification. It is your responsibility to ensure that you have a valid passport and have obtained all relevant visas & re-entry permits. For international travel you must ensure your passport has a validity of at least 6 months validity from the date of return. Boarding may be refused by the airline or cruise line company or country if your documentation is not correct.

Visas

It is the passenger’s responsibility to ensure they have the appropriate documentation including applicable visa(s) and a return or onward journey ticket. You may require a visa of electronic travel authorisation to enter some countries and vary depending on whether you are travelling for tourism purposes or business.

It is currently mandatory for Australian citizens to have a Visa to enter India.

VISA NOTES

Divinity Travel recommends applying for a tourist visa approximately 4 weeks prior to your commencement of travel to India.

E-Visa can only be applied for 34 days in advance and is valid for a maximum of 30 days from date of entry into India through the Government of India website. *Only valid for specified entry points.*

For tourist visas greater than 30 days, applications must be made on-line through your local VFS office. Please check all current requirements through the official VFS organisations or Indian government for processes and eligibility as noted on the links above. Divinity Travel is happy to assist with any enquiries.

Travel Insurance

Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade and Divinity Travel for all overseas travel. Our Agency Partner Sanctuary Travel is are an authorised representative of Covermore Travel Insurance Services Pty Ltd & QBE Australia.

We recommend your travel insurance provides cover for all medical expenses, cancellations, loss of luggage and personal effects.

You must obtain a Product Disclosure statement relating to the travel insurance product you are considering purchasing and you should read this document before making any decision about whether to acquire the product. Please read the conditions of the travel insurance policy carefully, taking note of any special inclusions or exclusions that may relate to your personal circumstances.

Should you opt to decline travel insurance you may be required to sign a disclaimer.

Quoted Prices

All prices are subject to availability, quoted in Australian dollars and correct at the time of quoting. Prices are subject to change and can be withdrawn or varied without notice and are only guaranteed once paid for in full.

Price changes may occur by reason of matters outside our control which increase the cost of the product or service. These variations may include but not limited to variations in exchange rates, fuel surcharges, government taxes, levies and airfare increases.

However, all attempts will be made to absorb minor alterations in currency fluctuations.

Changes to Itineraries

In the unlikely event that changes to the specified itinerary occur, Divinity Travel reserve the right to change the trip itinerary and are not responsible for any alterations to the packages provided by suppliers due to unforeseen circumstances beyond our control or force majeure

It is understood that the route, schedules, itineraries and mode of transport outlined is subject to alteration without prior notice due to local circumstances or events.

Payment Options

You will be required to pay a non-refundable deposit on booking. Your consultant will advise you how much that is and provide you with specific booking conditions to your tour and all other payment due dates. These dates must be adhered to in order to secure your booking.

Quoted prices are valid for Cash, Cheque and Direct bank deposit. Please note that payment by cheque will need to be made at least 10 business days prior to the due date to allow for processing. Payment by credit card will incur a surcharge of 1.8% for Visa and MasterCard. Premium Cards are gladly accepted, however additional surcharges apply, please enquire.

Frequent Flier and Special requests.

When making a booking , please let us know your frequent flyer membership details (or other applicable loyalty program details) for inclusion in your booking.

Please check your frequent flyer program (or other applicable loyalty program) for the specific terms of your membership. We cannot guarantee, nor are responsible for the supplier to credit you with relevant points for your booking.

Please advise your consultant of any special meal, seating, special needs or room requests.

Amendment or Cancellation Fees

Once payments have been made, cancellation or amendment fees apply to any changes in your travel arrangements.
Cancellation by You:
You must provide Divinity Travel with written Notice if you wish to cancel a booking. In the event you cancel your booking all deposits paid are non-refundable.

If you have made any further payments, between 30 and 60 days prior to departure we will retain 50% of the total booking cost. Less than 30 days prior to departure suppliers may also impose cancellation fees which can be up to 100% of the cost of the booking, regardless of whether travel has commenced.

Divinity Travel liability will be limited to a refund of any monies paid by you for the tour ground component of your booking, less any cancellation fees. EOI Tours will only provide a refund to you once any funds are received from ground suppliers.

Cancellation by Divinity Travel:
We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
Amendments
Any changes to a private or group tour itinerary will incur an administration fee of AUD $125 per person. This is in addition to any supplier fees which may be charged.
If you leave a tour or trip for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made.

Supplier Change and Cancellation Fees:

In addition to any amendment or cancellation fees charged by Divinity Travel, travel providers and suppliers may also apply change and cancellation fees, where a booking is changed or when tickets or documents are re-issued, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced.
Our liability will be limited to a refund of all monies paid by you less any cancellation fees and subject to the supplier’s terms and conditions. We will only provide a refund to you once we receive the funds from that supplier.

Travel Advice

We recommend that you contact the Department of Foreign Affairs and Trade (DFAT) for travel advice or visit their website at www.smartraveller.gov.au

You can register your travel plans with DFAT in the unlikely case you need to be contacted in case of emergency. www.dfat.gov.au

Health

We recommend that you check with your doctor or nearest Traveller’s Medical Centre regarding any vaccination or up to date medical requirements for your trip. Divinity Travel needs to be advised in writing of any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements and to allow us to advise suppliers on the ground for suitable arrangements for any physical limitations.

Privacy Policy

Divinity Travel is committed to protecting the privacy and confidentiality of the personal information that we hold. Travel Company

Divinity Travel acts as a travel company that sells travel related products and services on behalf of transport and service providers and suppliers such as airlines, cruise, rail and coach operators, accommodation and wholesalers.

You authorise us to make all bookings on your behalf subject to the terms and conditions provided by third party suppliers. All arrangements are subject to the supplier’s transport, accommodation, tour provider regulations and conditions detailed on tickets, vouchers, travel brochures, at accommodation premises, on transport vehicles, or as advised at the time of booking

Your legal rights in connection with the provision of travel services are against the specific provider or supplier. If for any reason any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against Divinity Travel or any trading entities.

To the fullest extent permitted by law you release us for:

  • any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions.
  • you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip

Complaints

If you have a complaint about your trip please inform our local representative at the time in order that they can attempt to resolve the matter immediately. If satisfaction is not reached through these means then any further complaint should be put in writing to Divinity Travel within 30 days of the end of the tour. All complaints must be received and handled in the State of Western Australia.

Governing Law

If any dispute arises between you and us, the laws and exclusive jurisdiction of the courts of Western Australia apply and you waive any right that you may have to object to an action being brought upon in those courts.

Acknowledgement

I acknowledge that I am 18 years of age or older and that I understand and agree with the above terms and conditions.
